It can happen that a will is securely stored but the only people who know where it is are the husband or wife. If they should die simultaneously, even though there is a will, no one will be able to find it.

We perform a monthly, real-time check with the South African Department of Home Affairs to ensure that if you have died we can proactively contact all relevant parties about the existence of your will.

Remember, if your will is lost a "Government will", that is, the Intestate Succession Act, will determine who inherits your estate. Effectively, the contents of the Intestate Succession Act will become your will.

This fact can work to certain people's advantage, especially if they know they are not beneficiaries in your will but stand to inherit through the Intestate Succession Act. It is not in their best interest to “find” your will.
